Trademark and patent attorney and managing partner of IPStyle Mariya Ortynska was a lecturer at the course “Legislative novelties of 2021. Effective building the work of a lawyer” by Legal High School.
At the lecture, Mariya considered the changes in the legislation of Ukraine on trademarks relating to procedural issues, the main innovations and problematic issues.
Mariya told about the changes of 2020, in particular, analyzed the Laws of Ukraine № 703 dated 16.06.2020 and № 815 dated 21.07.2020.
The lecturer considered “cosmetic” changes, institutional changes, as well as changes in certain norms, in particular, the conditions for granting legal protection of TMs, TM objects, registration of colour as TMs, the grounds for refusal of TMs registration, warning labels, comparative advertising, etc.
Mariya paid special attention to the changes in legislation on termination and early termination of the TM certificate, the right to re-registration of TM, registration of TM by an agent or representative, as well as such ground for refusal of registration of TM as “likelihood of association”, citing examples from Benelux and EU practice.
